ExamPrepIQ — Terms & Conditions

These Terms & Conditions (“Terms”) govern your access to and use of the ExamPrepIQ website, applications and services (together, the “Service”), operated by ExamPrepIQ (“ExamPrepIQ”, “we”, “us” or “our”). By accessing, browsing, registering for or using the Service in any way, you confirm that you have read, understood and agree to be bound by these Terms and by our Privacy Policy. If you do not agree to these Terms, you must not access or use the Service.

1. Who we are and what the Service is

ExamPrepIQ is an independent online exam-preparation platform. We provide practice questions, mock papers, and automated, AI-generated grading, scoring and feedback for a range of admissions and language examinations, including (without limitation) IELTS, LNAT, TARA and TMUA.

The Service is provided for personal study and preparation purposes only. It is a practice and revision aid — it is not, and does not purport to be, an official examination, an official preparation course, or a substitute for professional tuition or advice.

2. No affiliation with examination bodies

ExamPrepIQ is not affiliated with, endorsed by, sponsored by, or otherwise connected to any of the organisations that own, create or administer the examinations we help you practise for. All examination names, trademarks, logos and brands are the property of their respective owners and are used on the Service for descriptive and reference purposes only, to identify the practice material provided.

Our practice questions, mock papers and materials are created by us and/or generated using artificial intelligence. They are illustrative of the style and format of the relevant examinations; they are not past, leaked, official or actual examination questions.

3. Eligibility and accounts

To use the Service you must be at least 18 years old and capable of entering into a binding contract. If you are under 18, you may only access or use the Service with the involvement, supervision and verifiable consent of a parent or legal guardian, who agrees to these Terms on your behalf and is responsible for your use of the Service.

You may need to register for an account (including via third-party sign-in such as Google) to access certain features. You agree to:

  • provide accurate, current and complete information;
  • keep your account credentials confidential and not share your account with anyone else;
  • be responsible for all activity that occurs under your account; and
  • notify us promptly at support@examprepiq.com of any unauthorised use of your account.

We may suspend, restrict or terminate your account at our discretion, including where we reasonably believe these Terms have been breached.

4. AI-generated content, scores and feedback

A core part of the Service uses artificial intelligence to generate practice content and to mark, score and give feedback on your answers, essays and spoken responses. You acknowledge and accept that:

  • AI-generated scores, band estimates, marks and feedback are indicative and automated only — they are not official results and carry no official standing whatsoever;
  • automated grading may be inaccurate, incomplete, inconsistent or wrong, and may differ, sometimes significantly, from the outcome you would receive in an actual examination;
  • AI-generated content may contain errors, omissions or material that is out of date; and
  • you must exercise your own judgement and should not rely on the Service as the sole basis for any decision, including any decision relating to your studies, examinations, applications or career.

Any reliance you place on AI-generated scores, feedback or content is strictly at your own risk.

5. No guarantee of results or outcomes

We do not warrant, guarantee or promise any particular result or outcome from your use of the Service. In particular, we do not guarantee that using the Service will improve your performance, that you will achieve any particular score or grade, that you will pass any examination, or that you will be admitted to any institution, course or programme.

Examination results and admissions decisions depend on many factors outside our control. You remain solely responsible for your own preparation, examination performance and applications.

6. Subscriptions, fees and payment

Parts of the Service are offered free of charge and others require a paid subscription or plan. Where fees apply, the applicable prices, features and billing terms will be presented to you before you purchase.

Unless expressly stated otherwise:

  • fees are quoted inclusive or exclusive of taxes as indicated at the point of purchase, and you are responsible for any applicable taxes;
  • paid plans may renew automatically for successive periods until cancelled, and you authorise us (and our payment processors) to charge the applicable fees to your chosen payment method;
  • you may cancel future renewals at any time, effective at the end of the then-current billing period; and
  • except where required by law or expressly stated by us, fees already paid are non-refundable and are not credited on a pro-rata basis.

We may change our prices and plan features from time to time. Changes will not affect the period you have already paid for, and we will give reasonable notice of price changes that affect an ongoing subscription. Payments may be processed by third-party payment providers, whose terms also apply.

7. Intellectual property and licence to you

The Service and all of its contents — including all practice questions, passages, mock papers, answer keys, explanations, model answers, audio, text, graphics, software, design and the ExamPrepIQ name and branding (together, the “Content”) — are owned by us or our licensors and are protected by copyright, database, trademark and other intellectual property laws. The Content is our valuable confidential and proprietary material.

Subject to your compliance with these Terms, we grant you a limited, personal, non-exclusive, non-transferable, non-sublicensable and revocable licence to access and use the Content solely for your own personal, non-commercial study. This licence grants you no ownership rights and reserves all rights not expressly granted.

To protect our Content we may embed invisible, per-user identifying information (including watermarks) into material served to your account, and we may log and monitor access. Any leaked, copied or redistributed Content may therefore be traced back to the account that obtained it.

8. Acceptable use and prohibited conduct

You agree that you will not, and will not permit or assist any third party or automated agent to:

  • copy, reproduce, download in bulk, republish, distribute, sell, licence, sublicence, rent, share or otherwise make available any Content to any other person or platform;
  • scrape, harvest, crawl, spider, data-mine or systematically extract Content, or access the Service through any automated means, bot or script, other than as we expressly permit;
  • circumvent, disable, probe or interfere with any security, rate-limiting, watermarking, encryption, access-control or content-protection measure of the Service;
  • reverse engineer, decompile or attempt to derive the source code or underlying structure of the Service, except to the extent this restriction is prohibited by applicable law;
  • share, sell or transfer your account, or use a single account for the benefit of multiple people or any commercial exam-preparation operation;
  • use the Service to build, train or improve any competing product, dataset or machine-learning model;
  • introduce any malware, or take any action that imposes an unreasonable load on, or disrupts the integrity or performance of, the Service; or
  • use the Service in any way that is unlawful, fraudulent, infringing or harmful, or that infringes the rights of others.

Copying, extracting, scraping, reproducing, storing, republishing or reusing any Content or data from the Service without our prior written permission is strictly prohibited. Such conduct infringes our intellectual property and other rights and is a punishable offence under applicable law — including the Copyright Act, 1957 and the Information Technology Act, 2000 — exposing you to civil liability (including damages, accounts of profits and injunctions) and criminal prosecution. We actively monitor for unauthorised copying (including through the identifying information embedded in served Content, see clause 7) and will report and pursue offenders to the fullest extent of the law.

Breach of this clause is a serious breach of these Terms and may result in immediate suspension or termination of your account, forfeiture of any fees paid, and further legal action.

9. Your content

The Service allows you to submit answers, essays, audio recordings and other material (“User Content”). You retain ownership of your User Content. You grant us a worldwide, royalty-free licence to host, store, reproduce, process and analyse your User Content for the purposes of operating and providing the Service to you — including transmitting it to our AI grading providers to generate scores and feedback — and to maintain and improve the Service.

You are solely responsible for your User Content and confirm that you have the right to submit it and that it does not infringe the rights of any third party or violate any law.

10. Privacy and third-party services

Our collection and use of personal data is described in our Privacy Policy, which forms part of your agreement with us. The Service relies on third-party services (for example, authentication providers, cloud hosting, AI providers and payment processors). Your use of those services may also be subject to their own terms and policies, and we are not responsible for the acts or omissions of third parties.

11. Availability, changes and discontinuation

We provide the Service on an ongoing basis but do not guarantee that it will be available uninterrupted, secure or error-free. We may modify, suspend, withdraw or discontinue all or any part of the Service, including any feature or Content, at any time, with or without notice, and we will not be liable to you for doing so.

We may perform maintenance, apply updates and impose usage limits as we consider appropriate to operate the Service.

12. Disclaimer of warranties

To the maximum extent permitted by law, the Service and all Content are provided “as is” and “as available”, without warranties of any kind, whether express, implied or statutory, including any implied warranties or conditions of merchantability, satisfactory quality, fitness for a particular purpose, accuracy, and non-infringement.

Without limiting the above, we make no warranty that the Content, scores or feedback are accurate, complete, current or reliable, or that the Service will meet your requirements or achieve any intended result.

13. Limitation of liability

Nothing in these Terms excludes or limits our liability where it would be unlawful to do so — including for death or personal injury caused by our negligence, for fraud or fraudulent misrepresentation, or for any other liability that cannot be excluded or limited under applicable law.

Subject to the paragraph above, to the maximum extent permitted by law:

  • we (together with our directors, employees, agents and suppliers) will not be liable for any indirect, incidental, special, consequential or punitive loss or damage, or for any loss of profits, revenue, goodwill, opportunity, data, savings, or examination or admission outcomes, however arising, whether in contract, tort (including negligence), breach of statutory duty or otherwise, even if we have been advised of the possibility of such loss;
  • we will not be liable for any loss or damage arising from your reliance on any AI-generated score, feedback or Content, from any inaccuracy in the Content, from any examination result or admissions decision, or from any unavailability of the Service; and
  • our total aggregate liability to you arising out of or in connection with the Service and these Terms will not exceed the greater of (a) the total amount you paid to us for the Service in the twelve (12) months immediately before the event giving rise to the liability, or (b) five thousand Indian rupees (₹5,000).

You agree that these limitations are reasonable given the nature of the Service and the fees (if any) charged.

14. Indemnity

You agree to indemnify and hold harmless ExamPrepIQ and its directors, employees, agents and suppliers from and against any claims, liabilities, damages, losses and expenses (including reasonable legal fees) arising out of or connected with your breach of these Terms, your misuse of the Service, your User Content, or your violation of any law or the rights of any third party.

15. Suspension and termination

You may stop using the Service and close your account at any time. We may suspend or terminate your access to the Service (in whole or in part) immediately and without notice if you breach these Terms, if we are required to do so by law, or if we reasonably consider it necessary to protect the Service, our Content or other users.

On termination, the licence granted to you ends and you must stop using the Service and Content. Any provisions that by their nature should survive termination — including intellectual property, disclaimers, limitation of liability, indemnity and governing law — will survive.

16. Changes to these Terms

We may update these Terms from time to time to reflect changes in our Service, our business or the law. When we do, we will update the “Last updated” date above and, where the changes are material, take reasonable steps to notify you. Your continued use of the Service after the updated Terms take effect constitutes your acceptance of them. If you do not agree to the updated Terms, you must stop using the Service.

17. Governing law and disputes

These Terms, and any dispute or claim arising out of or in connection with them or the Service (including non-contractual disputes or claims), are governed by and construed in accordance with the laws of India, and the courts at Bengaluru, India will have exclusive jurisdiction, except that nothing in this clause limits any mandatory rights or protections available to you as a consumer under applicable law, including the Consumer Protection Act, 2019, or your ability to bring proceedings where such law permits.

18. General

These Terms, together with our Privacy Policy and any terms presented at the point of purchase, are the entire agreement between you and us regarding the Service. If any provision is found to be unenforceable, the remaining provisions will continue in full force. Our failure to enforce any right or provision is not a waiver of it. You may not assign or transfer your rights under these Terms without our consent; we may assign ours to an affiliate or successor. We are not liable for any failure or delay caused by events beyond our reasonable control. These Terms do not create any agency, partnership or joint venture between you and us, and confer no rights on any third party.
